UK Crowd Filming Privacy Notice
Scope of this Privacy Notice
If you are reading this, you will have seen our Crowd Filming Notice. This Privacy Notice provides you with information about how we process footage of people captured on camera during any crowd filming. “We” are the company that was listed on the Crowd Filming Notice. If the crowd footage contains any personal data relating to you, we will be the “data controller”.
This Privacy Notice applies only to those who were captured during crowd filming scenes, which will have been clearly marked with the Crowd Filming Notice. Not everyone who was in the area will have been captured and if you were not captured then we will not process your personal data
How we use your personal data
We only process your personal data for the purposes of producing content such as a film or a television programme (“production”). Anyone incidentally captured in crowd filming will not be the focus of any scene in any of our productions, however you may be identifiable.
Our lawful basis for processing your personal data is that it is in our legitimate interests, namely so that we can capture necessary footage for our production. Where footage may reveal a special category of personal data (i.e. data that is more sensitive), we will only use it if we have a further justification permitted under data protection law, for example that the use is in the substantial public interest.
How we share your personal data
As part of the process of creating, marketing and distributing our production, the footage may be shared with other members of our group and companies involved in the production (such as those commissioning the production or those involved in distributing the production), service providers and professional advisors. Footage that is incorporated into the final film or programme or related promotional or digital materials will be seen by viewers.
International transfers
If we transfer your personal data to group entities or service providers outside of the UK, we will ensure that a similar degree of protection is afforded to it – specifically we will only transfer your personal data to countries with adequate data protection laws or pursuant to appropriate contractual protection in accordance with data protection laws.
How long we keep your personal data for
We retain personal data for the period of time necessary to fulfil the purposes for which we obtained it and consistent with applicable data protection law.
Exercising your rights
Under data protection law, under certain circumstances you have the following rights in relation to your personal data: (i) request access to your personal data; (ii) request correction of your personal data; (iii) request erasure of your personal data; (iv) object to processing of your personal data; (v) object to the processing your personal data; (vi) request transfer of your personal data to another controller; and (vii) the right to withdraw consent where it has been obtained.
